terms and conditions

These terms cover booking, paying for and attending classes at AND SCULPT. Booking a class means you accept them.

1. who we are

AND SCULPT is operated by HKLJ Limited t/a And Sculpt, Company No. 72603228, an infrared-heated sculpt studio in residency at Room 3904, 39th Floor, The Upper House, Pacific Place, Admiralty, Hong Kong. In these terms, "we", "us" and "the studio" mean AND SCULPT, and "you" means the person booking or attending a class.

These terms apply to every class, class package, private booking and use of our website and booking system. By making a booking, you confirm that you have read and accepted them.

2. age and eligibility

Guests aged 18 and over may book and attend classes on their own account.

Guests aged 16 and 17 may attend only with the written consent of a parent or legal guardian, who must complete the health declaration and waiver on their behalf and accept these terms for them. We do not accept guests under 16.

We may decline or cancel a booking at our discretion, including where we believe a class is not suitable or safe for a particular guest.

3. your account

All bookings are made through our booking platform, Momence. Every guest needs their own Momence account and must complete the health declaration and waiver before their first class.

You are responsible for keeping the information on your account accurate and up to date, and for anything done through your account. Accounts, credits and packages are personal to you and cannot be shared, transferred or sold, unless a package is expressly sold as a shareable one.

4. classes we offer

All classes are 55 minutes, mat-based and low-impact, and take place in an infrared-heated room. Every class is capped at six guests.

hot sculpt fundamentals is heated to 33°C — the essentials, cued clearly, in a gentler room.

hot sculpt is heated to 38°C — our signature class, with more progression and more heat.

Mats, hand weights and ankle weights are provided, as are towels for class and for the shower. The studio has one shower with amenities, a filtered tap for refilling water bottles, and no lockers.

5. prices and payment

Current prices are shown on our website and in the Momence app, in Hong Kong dollars. Payment is taken in full at the time of purchase. A class is only booked once payment or a valid credit has been applied.

We may change our prices at any time. A change never affects a package you have already bought.

6. credits and validity

Class packages are sold as credits with a fixed validity period, which is stated at the point of purchase. Credits expire at the end of that period whether or not they have been used.

trial sculpt — two classes, valid 30 days from purchase, for new guests only.

single sculpt — one class, valid 14 days from purchase.

five sculpt pack — valid 30 days from purchase.

ten sculpt pack — valid 3 months from purchase.

fifteen sculpt pack — valid 4 months from purchase.

private group sculpt — a studio buy-out for up to six guests, valid 4 months from purchase.

Credits have no cash value, cannot be exchanged for cash, and cannot be transferred to another person.

7. booking and cancellation

Book, reschedule and cancel through the Momence app. Cancellations made there free the place for someone else.

Cancellations made more than 12 hours before the class start time return the credit to your account in full.

Cancellations made less than 12 hours before the class start time, and no-shows, are charged in full and the credit is forfeited. With six places in a room, a late cancellation is a place nobody else can take.

8. waitlists

If a class is full you can join its waitlist. If a place opens, Momence notifies you and enrols you automatically. Notifications go out at least 6 hours before afternoon classes and 12 hours before morning classes.

If that notice period does not work for you, remove yourself from the waitlist so that you are not enrolled automatically.

If we enrol you from the waitlist less than 12 hours before the class — which can happen, because a place may open after the free-cancellation window has closed — you may cancel without charge within two hours of being enrolled. We will not charge you for a class you did not choose to book.

9. arriving on time

If it is your first class, arrive ten to fifteen minutes early. There is no lobby space at the studio, so please do not arrive much before that.

The studio door is locked five minutes after class begins and we cannot admit anyone after that point. The room is small, and the heat and the flow both depend on it. A guest who arrives after the door closes is treated as a no-show and the class is charged in full.

10. private classes

Private classes are a full studio buyout for up to six guests, scheduled outside our regular timetable, at a flat rate. Arrange one by email.

Private bookings are confirmed on payment. Every guest attending still needs their own Momence account and signed waiver. Cancellation terms for private bookings are agreed in writing at the time of booking.

11. refunds and extensions

Class packages and credits are non-refundable, including where they expire unused.

We know life happens. If illness, injury, travel or another genuine reason means you cannot use your credits, email us — we can often help, and extensions are considered case by case at our discretion. If you are waiting on an extension, book a single class in the meantime rather than losing your place.

Nothing in these terms affects any rights you have under Hong Kong law that cannot be excluded by agreement.

12. your health

Our classes take place in a room heated to 33°C or 38°C. Training in heat places additional demand on the body.

You confirm that you are in good general health and medically able to take part. Please speak to your doctor before booking, and tell us before class, if any of the following apply to you: pregnancy; heart, blood pressure or circulatory conditions; respiratory conditions; diabetes; a condition affecting your ability to regulate temperature or stay hydrated; recent surgery or injury; or any medication that affects heat tolerance.

You must tell your instructor about any injury, condition or concern before the class starts, and you agree to keep your account's health declaration current.

Work at your own pace. Every exercise has a lighter option and the weights are optional. Come out of anything that does not feel right, take water when you need it, and leave the room if you feel unwell.

13. risk and liability

Physical exercise carries inherent risk of injury, and heated exercise carries additional risk. By attending, you accept those risks voluntarily.

We take reasonable care in running our classes and maintaining the studio. We are not liable for injury, loss or damage that is not caused by our negligence or breach of these terms, or that was not reasonably foreseeable.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited or excluded.

14. conduct in the studio

The studio is a shared space with six people in it. We ask that you treat instructors and other guests with respect, arrive clean and ready to train, keep phones silent and away during class, and follow your instructor's directions.

We may ask a guest to leave, or decline future bookings, in cases of harassment, discrimination, abusive or threatening behaviour, attending under the influence of alcohol or drugs, or repeatedly disrupting classes. No refund is given where we do so.

15. your belongings

There are no lockers at the studio, so please bring as little as you can. You remain responsible for your own belongings. We are not liable for loss of or damage to personal property brought to the studio, except where caused by our negligence.

16. photography

We occasionally photograph or film in the studio for our own marketing. We will always tell you before we do, and you can ask not to appear — say so and we will work around you, at that class and afterwards.

If you appear in material we capture, you agree we may use it across our website, social media and marketing. You can withdraw that agreement at any time by emailing us, and we will stop using the material going forward.

Please do not photograph or film other guests without their agreement.

17. schedule changes

We may change, combine or cancel a class, or substitute an instructor. Where we cancel a class you are booked into, your credit is returned to your account in full and you may rebook.

Classes need a minimum number of guests to run. Where a class does not reach that minimum we may cancel it, and we will let you know as early as we can.

18. your personal data

We collect the information you give us when you create an account, complete your waiver and health declaration, book classes and contact us. We use it to run your bookings, keep you safe in class, take payment, and — where you have agreed to hear from us — to send you studio news.

We handle personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong. We do not sell your data. We share it only with the providers we need to run the studio, such as our booking platform and payment processor.

You may ask us for a copy of the personal data we hold about you, ask us to correct it, or ask us to stop sending you marketing, by emailing hello@andsculpt.com.

19. booking and payment providers

Bookings run through Momence and payments are handled by our payment provider. Their own terms and privacy policies apply to your use of those services alongside ours.

We are not responsible for a failure or interruption of a third-party service. If a technical fault means you are wrongly charged or wrongly enrolled, tell us and we will put it right.

20. our brand and content

The AND SCULPT name, logo, class names, website content, class programming and photography belong to us. You may not copy, film, teach from or commercially reuse our class content or branding without our written permission.

21. events outside our control

We are not liable for a failure to provide classes caused by something outside our reasonable control — including typhoon or black rainstorm warnings, public health restrictions, power or water failure, or loss of access to the building.

Typhoon and rainstorm: classes are cancelled when Typhoon Signal No. 8 or above, or the Black Rainstorm Warning, is in force at the class start time, or is hoisted within two hours of it. Where a signal is lowered more than two hours before a class, that class runs as scheduled. We will let you know through Momence and on Instagram as soon as we can.

Where classes are cancelled for such a reason, we will return the credit to your account or extend your package validity.

22. changes to these terms

We may update these terms from time to time. The current version is always on our website, with the date it took effect. Changes apply to bookings made after that date; a package you have already bought keeps the terms it was bought under.

23. governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region, and the Hong Kong courts have exclusive jurisdiction over any dispute arising from them.
